The student’s school of current enrollment will include a behavioral program of positive interventions to address the causes of misbehavior as part of the in-school suspension. h. An in-school removal is not considered a day of suspension as long as the student is afforded the opportunity to continue to: i. Appropriately progress in the general curriculum; ii. Receive the special education and related services specified on the student’s IEP, if the student is a student with a disability in accordance with COMAR 13A.05.01; iii. Receive instruction commensurate with the program afforded to the student in the regular classroom; and iv. Participate with peers as they would in their current education program to the extent appropriate. 4. Out-of-School Suspension for Not More than 10 Days a. Suspensions of ten days or less are within the authority of the building principal. b. A student may not receive an out-of-school suspension unless the student has been informed of the reasons for the suspension and has been given an opportunity to respond before the suspension becomes effective. Parent(s)/guardian(s) can request to discuss the consequences and prior interventions and supports with the administrator and/or to review the student's written conduct history. c. The school principal will provide the student’s parent(s)/guardian(s) with written notification of the out-of-school suspension action taken by the school. Parent(s)/guardian(s) can request to discuss the consequences and prior interventions and supports with the administrator and/or to review the student's written conduct history. d. A principal may request five days of suspension beyond the five days assigned by the school administrator through written request to the Assistant Superintendent for Student and Family Services. Upon receipt of the request for additional days of suspension up to a total of 10 days of suspension, the Assistant Superintendent for Student and Family Services or his/her designee will again address due process in a meeting with the student and parent/guardian and will follow policy protocol for assignment of any additional days of suspension. e. A student whose presence in school poses a continuing danger to persons or property or an ongoing threat of disruption to the academic process may be removed immediately from school if the notice and conference required are provided as soon as possible. If such removal is necessary, the school shall immediately notify the
