Parent/guardian may appeal suspension in accordance with timelines detailed in the Wicomico County Public Schools Code of Conduct. 5. Out-of-School Suspension for More than 10 Days or Expulsion a. At the request of a principal, the Superintendent or the designated representative may suspend a student for more than 10 school days or expel the student. b. Upon receipt of a written request from a principal requesting an extended suspension or expulsion, the Superintendent or designated representative promptly shall make a thorough investigation of the matter. The written request will include list of non-exclusionary interventions implemented prior to the decision to suspend. c. If after the investigation the Superintendent or designated representative finds that an extended suspension or an expulsion is warranted, the Superintendent or designated representative promptly shall arrange a conference with the student and the student’s parent(s)/guardian(s) within 24 hours of this contact. This notification may be verbal or written and shall include: i. Statement of the reasons for the recommended action ii. Notice that the student will receive a conference on the question of extended suspension or expulsion iii. Date, time and location of conference iv. Information regarding whom the parent/guardian should contact if they need to reschedule the conference v. A statement that the student must be present at the due process conference d. At the conference, the Superintendent or designated representative shall: i. Inform parent/guardian and student of allegations against student ii. Provide the student with the opportunity to respond to allegations, verbally or in writing, and to present the student's version of events iii. Provide student the opportunity to present evidence in the student's defense iv. Permit the student to be accompanied by counsel or appropriate representative of the student's or parent's choice e. At the conference, the Superintendent or designated representative shall consider: i. Compliance with procedural requirements regarding notice ii. Whether the extended suspension or expulsion complies with the Code of Conduct iii. The school's efforts to utilize non-exclusionary alternatives
