BOX 1538 2424 NORTHGATE DRIVE., SUITE 3, SALISBURY, MD 21801 Procedure SFS-GEN-PR-029 extended suspension or an expulsion is warranted, the student or the student’s parent/guardian may appeal to the local board within 10 days after the determination. k. If an appeal is filed, the local board or its designated committee or hearing officer shall have 45 days from the date the appeal was received to hear the appeal and issue a decision, as follows: i. This timeline period may be extended if the parent/guardian or his/her representative requests additional time; and ii. This timeline shall also apply in the event that the local board elects to use a hearing examiner. l. If due to extraordinary circumstances or unusual complexity of a particular appeal, the local board determines that it will be unable to hear an appeal and issue a decision within 45 days, it may petition the State Superintendent for an extension of time. m. The student or the student’s parent(s)/guardian(s) or representative: i. Shall be provided the school system’s witness list and a copy of the documents that the school system will present at the hearing 5 days before the hearing; and ii. May bring counsel and witnesses to the hearing. n. Unless a public hearing is requested by the parent/guardian of the student, a hearing shall be held out of the presence of all individuals except those whose presence is considered necessary or desirable by the board. o. At the hearing, the Board of Education or its appointed hearing office shall consider the following: i. Whether the school complied with the procedural requirements regarding notice ii. Whether the school provided a due process iii. Whether the evidence was fully and fairly considered iv. Whether the school complied with the requirements in the Code of Conduct v. The school's efforts to utilize non-exclusionary alternatives prior to recommending extended suspension or expulsion vi. Whether all of the requirements for extended suspension and expulsion have been met p. The Board of Education will issue the written decision within ten school days of the Board meeting at which the appeal is considered. q. The appeal to the local board does not stay the decision of the Superintendent. r. If the Board of Education determines not to uphold the Superintendent or designee's recommendation, the school shall expunge all school records pertaining to the suspension from the student's file.
