Each level of the appeal process will generate a formal letter stating the 330 rendered decision to the parent and copied to the school team and the student's 331 cumulative record. 332 ix. Those students who are English Language Learners (ELL) will be provided 333 appropriate accommodations based on their Individual Learner Plan (ILP) developed 334 by the English as a Second Language (ESOL) teacher and provided to the classroom 335 teacher. The ILP be made available through the district’s student database for all 336 teachers assigned to the ELL student. When retention of an EL is determined to be the 337 best option, evidence of multiple interventions and scaffolded instructional strategies 338 must be documented to demonstrate the student is being retained for reasons other than 339 a lack of English proficiency. 340 C. Placed in Next Grade 341 1. Students may be "placed" but not “promoted” in the next grade based on evidence of 342 insufficient progress. A student "placed" in the next grade must meet at least one of the 343 following criteria: 344 a. Has been retained at least once in the previous grade and has continued to show 345 evidence of little or no progress in academic grades, content assessments, etc. 346 b. Has been seriously considered for non-promotion in the current grade and for whom 347 the decision has been made by the team not to retain. Being "placed" in the next grade 348 level indicates the student, may be "at risk" for achieving success. 349 2. The Student Services Team is required to create a formal, written, detailed Individualized 350 Learning Plan for the student who is "placed" in the next grade, to be used to provide 351 support to the struggling student in the next grade level. The student must be maintained 352 on the Student Services Team roster for the next school year. The SST will monitor the 353 Individualized Learning Plan and provide appropriate interventions. 354 3. Parents/Guardians are requested to sign the Wicomico County Public Schools “Non355 Promotion” form during a face-to-face meeting with the classroom teacher, the principal, 356 and others designated by the principal. Signature indicates receipt of form as noted below 357 parent/guardian signature line on the form. The Non-Promotion form and a formal letter 358 from the principal indicating the decision to “place” the student in the next grade are 359 mailed to the parent/guardian and copied to the student’s cumulative record file and to the 360 Student Services Team accompanied by the Wicomico County Public Schools “Non361 Promotion” form. 362 4. Parents/Guardians who are not in agreement with the school team to place their child in 363 the next grade for the coming school year instead of a promotion must follow the appeal 364 process, in writing, to the principal (Level I), followed by the Director of Elementary 365 Education (Level II), the Chief Academic Officer (Level III) and then the Superintendent 366
