A student is considered in attendance at school when participating in school sponsored 76 activities during the school day, and when that participation is approved by the 77 superintendent of schools or the school principal, or their designees. Students shall be 78 considered in attendance in an alternative program setting when participating in activities 79 during the day sponsored by the alternative program, and when that participation is 80 approved by the director of a licensed childcare center, registered family day care, or 81 Head Start 5-year-old program. 82 2. Lawful and Unlawful Absences are established and/or amended by COMAR 13A.08.01.03 83 and 13A.08.01.04 as they now exist or are amended. 84 a. Lawful Absence - Students presently enrolled in public schools are considered lawfully 85 absent from school, including absence for any portion of the day, only under the 86 following conditions: 87 i. Death in the immediate family. 88 ii. Illness of the student. 89 1. The principal or a pupil personnel worker will require a health care provider’s 90 certificate from the parent or guardian of a student reported continuously absent 91 for physical illness or somatic health need. 92 2. An absence due to a student’s behavioral health is treated the same as an absence 93 due to illness or another somatic health need. If a student or the student’s parent 94 or guardian notifies their school that their child’s absence was due to a behavioral 95 health need, the school will provide information to the student or the student’s 96 parent or guardian about school or community behavioral health resources that are 97 available to the student. 98 iii. Pregnant and parenting students. 99 1. Allowance for labor, delivery, and prenatal and postnatal medical appointments, 100 with a health care provider’s note. 101 2. Provision of a minimum of ten (10) school days of excused absences for a 102 parenting student after the birth of the student's child, for both mother and co103 parent. 104 3. Allowance for any parenting-related absences due to an illness or a medical 105 appointment of the student's child, including up to 4 days of absences per school 106 year for which the school may not require a note from a physician. 107 4. Allowance for any absence due to a legal appointment involving the pregnant or 108 parenting student that is related to family law proceedings, including adoption, 109 custody, and visitation. 110 5. Allowance for any parenting-related absence from a class due to use of a lactation 111 space to nurse or express breast milk. 112 iv. Court summons.
